Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RinkOpswebsite, application, and related services (the "Services") operated by RinkOps Solutions LLC("Company," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

RinkOps is a software platform for ice rink and related organizations to manage scheduling, invoicing, maintenance, and other rink operations. Features may change over time. We may add, modify, or remove functionality with reasonable notice where practicable.

You must provide accurate registration information and keep your account credentials secure. You are responsible for activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) and authorized to bind your organization when registering on behalf of a rink or business.

Paid plans, free trials, and founding or promotional pricing are described on our website or in your order. Fees are billed according to the plan you select. Payments are processed by Stripe. Subscriptions renew automatically until cancelled according to the plan terms. Except where required by law, fees are non-refundable once a billing period has started.

You agree not to:

• Use the Services in violation of law or third-party rights
• Attempt to gain unauthorized access to the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Upload malware or use the Services to send spam or unlawful messages
• Reverse engineer or copy the Services except as permitted by law
• Use the Services to store or transmit sensitive data without appropriate safeguards and authority

You retain ownership of data you submit to the Services ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Services. You are responsible for obtaining any consents required to collect and use Customer Data (including contact information for email and SMS features).

The Services, including software, branding, and content we provide, are owned by RinkOps Solutions LLC or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding except as needed to use the Services in accordance with these Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RinkOps Solutions LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT PAID US.

You will defend and indemnify RinkOps Solutions LLC against claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your Customer Data, or your violation of these Terms or applicable law.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the Services ends; provisions that by nature should survive will survive (including limitations of liability and indemnification).

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles, except where mandatory local law applies. Disputes will be resolved in the courts located in New York, unless applicable law requires otherwise.

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
